Photograph caption dated November 1, 1938 reads, "As demure as a schoolgirl, Sally Rand, who makes her living off fans and balloons in front of a coating of talcum powder, is shown waiting for the jury's verdict at her battery trial. Hazel Drain and C. R. Stanford charged that Sally gave an extra performance in a theater aisle by biting and scratching them after she saw Stanford pictures of her fan dancing. The whole business now is up to the jurors, called 'beauty and shock proof' because they were asked if they would be swayed in the their judgment by the sight of Sally on the stand and reports about her fan dancing. All said they would rely solely on testimony."
