During the suit, Warner Bros.' representation maintained that the studio had the right to suspend Dvorak due to poor health. Dvorak produced X-rays to establish her physical fitness so as to continue working at Warner Bros.
Photograph caption dated February 18, 1936 reads, "Ann Dvorak in court for contract row renewal. X-rays of actress introduced in fight over health status."
