Ferguson had served in San Quentin State Prison for the grand theft of investment funds in the 1929 sale of the Malibu La Costa beachfront properties--faciliated by his former real estate company the Harold G. Ferguson Corporation. After his release, Ferguson testified at this 1935 trial, in which the Malibu investors were ultimately denied the recovery of $443,000 from the Bank of America National Trust and Savings Association and the Marblehead Land Company, the third-party companies Ferguson used to broker the Malibu deals.
