Scope/Content: Abstract: FERC issued docket number p-2082: On November 9, 2005, the Federal Energy Regulatory Commission ("FERC" or "Commission) issued a "Notice of Petition for Declaratory Order and Soliciting Comments, Motions to Intervene, and Protests" in the above-captioned proceeding. The Commission thereby created an entirely new sub-docket of docket P-2082 to address the "Petition for Declaratory Order" that the United States Department of Interior ("Interior" of "DOI") filed on October 3, 2005, to raise certain issues relating to the sale of power under the Link River Dam contract, and whether those contract terms and conditions should continue during any future annual licenses for the hydroelectric project. Pursuant to 18 C.F.R. §§ 385.211, 385.214, the Pacific Coast Federation of Fishermen's Associations ("PCFFA") and the Institute for Fisheries Resources ("IFR") hereby move to intervene in P-2082-039 and hereby also protest Interior's Petition on the grounds set forth below. Said notice provided a period within which interested parties may intervene of right as well as file all comments, protests and motions as "within 10 days of publication of this notice in the Federal Register." The Federal Register notification was published November 17th, 2005 (70 Fed. Reg. 69751). Filing of this Motion to Intervene and Protest is therefore with those 10 days and is thus timely. Previously the Commission has been dealing with precisely this same issue in another docket as an ancillary issue to FERC relicensing docket No. 2082-027. On or about November 2, 2005, PCFFA filed with the Commission a "Response To The Department Of Interior's Petition For Declaratory Order," under docket P-2082-027. PCFFA hereby incorporates herein by reference that Response and specifically requests that this prior PCFFA pleading be added to the record in the new docket, P-2082-039.
