Description: Scope/Content: Abstract: FERC issued docket number p-2082: Pursuant to 43 C.F.R. § 45.22, the Hoopa Valley Tribe (the "Tribe") hereby files this Notice of Intervention and Response to PacifiCorp's "Combined Request for Hearing On Disputed Issues of Material Fact Regarding U.S. Fish and Wildlife Service Section 18 Prescriptions and Bureau of Land Management Section 4(e) Conditions and Request to Consolidate All Hearings Regarding the Klamath Hydroelectric Project" (Hearing Request) filed on April 28, 2006. On March 29, 2006, the Department of Interior filed joint preliminary fishway prescriptions with the Department of Commerce pursuant to Section 18 of the Federal Power Act, 16 U.S.C. § 811 (Section 18 conditions). On the same date, the Department of the Interior also filed preliminary conditions under Section 4(e) of the Federal Power Act, 16 U.S.C. § 797(e) (Section 4(e) conditions). PacifiCorp has requested a hearing, pursuant to the Energy Policy Act (EPAct) of 2005 and 43 C.F.R. § 45.21, on a total of 36 issues which PacifiCorp characterizes as disputed issues of material fact. This Notice of Intervention and Response is timely filed and served within 15 days of service of the Hearing Request in compliance with 43 C.F.R. § 45.22.
