Scope/Content: Abstract: Pending before the Federal Energy Regulatory Commission (FERC or Commission) is a request for surrender of exemption and removal of dam for the Smelt Hill Dam and Hydroelectric Project No. 7118. In accordance with the Commission's procedures for complying with the National Environmental Policy Act (NEPA), and consistent with the regulations of the Council on Environmental Quality (CEQ) for implementing NEPA at 40 CFR Section 1506.3, the Commission has decided to adopt an environmental assessment (EA) produced by the U.S. Army Corps of Engineers (Corps), New England District in January 2001. The EA is titled: "Smelt Hill Dam Environmental Restoration Study - Falmouth, Maine." The EA concludes that removal of the Smelt Hill Dam would not be a major Federal action significantly affecting the quality of the human environment. The FERC staff has independently reviewed the EA, and agrees with its analysis and conclusions. The staff therefore finds that the EA meets the standards for an adequate environmental analysis under NEPA, and can be adopted.
