Telegraph from Ernest Besig to Roger Baldwin: "Because of conflicting decisions in Second and Fifth Circuits, the Ninth Circuit Court today certified following question to Supreme Court tin Korematsu case: After a finding of guilt in such a criminal proceeding as the instant case, in which neither imprisonment in a jail or penitentiary nor a fine is imposed, is an order by the district court, that the convicted man 'be placed on probation for a period of five (5) years.' a final decision reviewable on the appeal by this circuit court of appeal? Will you arrange filing motion to ring entire record before Supreme Court so that Korematsu case may be consolidated with others. We will order clerk to certify record. Please wire reply." The ACLU-Northern California case file records contain legal documents and correspondence pertaining to the case argued before the Supreme Court in Korematsu v. United States (1944), challenging the constitutionality of Executive Order 9066.
