DATE: February 13, 1969. REGARDING: The Legality of the Present Arrest Procedure at U.C. Berkeley TEXT of Press Release The Third World Liberation Front at the University of California, Berkeley deplores the tactics currently being used in the recent arrests of student, non-student, and teaching assistant strikers. Yesterday, February 13th, 36 arrests were made bringing the total number of arrests since the inception of the strike to 76 with numerous warrants still out. Of those arrested were both students and non-students on police charges ranging from a 242-arrest on a previous complaint; a 647 charge- the obstruction of public thoroughfare; to a 243 charge- felonious assault on a police officer. The AFT people were arrested for illegal picketing, when in fact, they were peacefully picketing without violation of police charge 647. It has now been postulated by members of the TWLF that the University of California Police, the Berkeley Police and the Alameda County Sheriffs have collaborated to conspire against strikers by implementing terroristic tactics in the arrests of strikers and striker sympathizers. These terroristic tactics refer specifically to: a) the brutality inflicted upon strikers arrested by plainclothesmen (evidence of police brutality and use of plainclothesmen to incite violence); b) there is evidence of the illegality involved in the issuance of pre-written warrants, and then the denial by the involved Police Departments of the existence of such warrants. In the latter instance, 'probability of cause' is in question as the warrants are issued only from photo evidence. Given this situation the TWLF demands that: 1) A thorough explanation of what a 'state of emergency' entails-especially as it relates to police priviledges on our campus and the Berkeley community at large. 2) We demand that any arrest made by a public arrest and that the victim be arrested while the offense is taking place and not after. 3) We demand that both the U.C. Police and Berkeley Police admit their subservience to Alameda Sheriff Madigan- the real instigator of unnecessary harassment on campus. WE ABHOR THE POLICE STATE ON OUR CAMPUS -- THE PEOPLE'S UNIVERSITY Communique #4---February 14, Friday, 1969 BROTHERS AND SISTERS: THE PRESENCE OF POLICE ON CAMPUS IS REPRESSIVE AND INTIMIDATING. THIS IS THE ONLY WAY THE ADMINISTRATION AND STATE POWERS KNOW HOW TO REACT TO A PEOPLE'S STRUGGLE. WE MUST STAY TOGETHER IN THE FACE OF ADVERSITY AND REPRESSION. PLEASE READ THE FOLLOWING INFORMATION; POLITICAL CONSCIOUSNESS IS OF UTMOST IMPORTANCE AND URGENCY. IT IS ESSENTIAL TO THE FREEING OF OUR PEOPLE. NOTICES: 1. Picketing from 10:00 am to 3:00 pm, at Bancroft and Telegraph, and at Sather Gate. Follow instructions from TWLF Monitors, and Strike Support Monitors. Discipline is essential. 2. There will be a Noon Rally in Sproul Plaza, sponsored by Committee on Public Safety (COPS). There will be 3 TWLF speakers. Please tell people to attend. 3. At 11:00 am, a Press Conference, featuring the AFT arrestees, and TWLF people in the ASUC Senate Chambers. 4. On Monday, February 17, a mass 3rd World Meeting, somewhere off-Campus, in the afternoon, to discuss the issues, and to get together. Please watch forces, leaflets, or call 642-4216 Monday, or 642-0802, during the weekend. 5) Also on Monday, a 5-6 page leaflet on the Power Structure of the University will come out, to educate everybody to the nature of our task ahead. The Communications Committee will need help on the following: a. passing out leaflets, Monday--stacks available in Plaza Tables and 506 Eshleman Hall. b. Collation, mimeographing, and stapling, Sunday, Chicano Center 2536 Channing Way. c. Writing and ideas, call 642-0802 during the weekend, leave name and phone. REPORTS: 1. Chancellor Heyns is not in town. He is Michigan at last report. He is not on Campus; rather, Cheic is handling the entire mess. It is a bad scene. He will be back (if not replaced) next week. This is how urgent and concerned the Administration is. We have to move on, in our urgency. 2. The TWLF Amnesty in Academics Committee will be demanding grade, credit, leniency, etc, for strikers from the Academic Senate and appropriate agencies. Everything is being done to take care of our people. People interested in working on that Committee, call 642-4216, and leave name and phone numbers. 3. The TWLF Steering Committee, made up of all Committee Heads, meets daily in the Chicano Center, at 4:00 pm, 2536 Channing Way. Help is needed on all TWLF Committees: Legal Defense; Communications; Community Liason; Finance; Monitors; Strike Support; Speakers Bureau; and Faculty, Administrators, and Employees. IMPORTANT*******IF ARRESTED, OR YOU KNOW OF SOMEBODY RIPPED OFF, CALL THE LEGAL DEFENSE CENTER, 642-0804, and leave the name with a secretary. Everything possible will be done to bail them out.
