Description
Approval of application for sole trader status filed by Elise d'Heirry [or Hurry? Heury?], a married woman, in the City of San Jose, for the proposed business of keeping a seminary and school for the education of "Young Ladies." Filed in the 3rd District Court, Santa Clara County, and recorded at the request of "E. D. Hierry" on the 25th day of September 1869 at 40 minutes past 4 o'clock in Liber A, Declarations of Sole Trader Records of Santa Clara County. "In the District Court of the Third Judicial District of the State of California, in and for the County of Santa Clara, September Term A. D. 1869, In open court September 25th 1869 before Hon. S. B. McKee Judge of said Court, In the Matter of the Application of Elise d'Heirry a married woman to become a sole trader. In the matter of the above entitled application, proof of publication of notice as required by law having been filed, and the Court having examined the applicant on oath as to the reasons, which induce her to make the application, and it appearing to the Court that a proper case exists, it is then hereby ordered that the said application Elise d'Heirry be authorized and empowered to carry on in her own name and on her own account in the City of San Jose County of Santa Clara, State of California, as a Sole Trader the business named in the said notice to wit: the business of keeping a seminary and school for the education of Young Ladies, and the Court having administered to the said applicant before the making of this order the following oath: I, Elise d'Heirry do in the presence of Almighty God truly and solemnly swear that this application is made in good faith for the purpose of enabling me to support myself and children, and not with any view to defraud delay or hinder any creditor or creditors of my husband, and that of the moneys so to be used in said business, not more than five hundred dollars has come, either directly or indirectly from my husband so help me God..."
